Terms
The terms for using Complly Risk, from your free trial onwards.
1. Who we are, and what these terms cover
Complly Risk is provided by Complly Construct Limited, a company registered in England and Wales (company number 17356591), registered office 304 High Road, Benfleet, Essex SS7 5HB (“we”, “us”). These terms apply when you create an account, take a free trial, subscribe, or open a document someone has shared with you to review. By doing any of those you agree to these terms and to our privacy notice.
Complly Risk is for businesses and people working in a trade. By using it you confirm you are using it for your business, not as a private consumer. A sole trader using Complly Risk for their trade is a business user.
2. What Complly Risk does
Complly Risk helps you draft and manage health and safety paperwork — risk assessments and method statements (RAMS), COSHH assessments, toolbox talks and construction phase plans — with Rodney, our assistant, and share them for review and sign-off. We keep improving it, so features may change. We aim to keep it available at all times but cannot promise it will never be interrupted.
3. Documents are drafts — the professional judgement is yours
What Rodney drafts is a starting point, not professional health and safety advice. Every document must be checked, changed where needed, and signed off by a competent person before anyone relies on it or works to it on site. You and your employer stay responsible for the accuracy, suitability and legal compliance of the documents you produce and use, and for the duties the law places on you.
4. Your free trial
You can try Complly Risk free for 14 days. No card is needed to start. When the trial ends, your account becomes read-only: your documents are kept and you can still open and download them, but you cannot make new ones until you subscribe.
5. Prices and paying
- A Complly Risk licence is £39 a month or £390 a year for the first person, and £30 a month or £300 a year for each extra person on the same account, with unlimited documents. Our current prices are on our pricing page.
- You pay in advance, by card, through Stripe. Your subscription renews automatically at the end of each month or year until you cancel it.
- When you add a person part-way through a period, you pay for them from the day they are added.
- We are not registered for VAT, so no VAT is charged. If that changes, we will tell you before VAT is added.
- If we change our prices, we will tell you at least 30 days before your next renewal, and the new price applies from that renewal.
6. If a payment fails
If a payment does not go through, we will tell you and you have 7 days to put it right. If it is still unpaid after that, your account becomes read-only, as at the end of a trial, until the payment is made.
7. Cancelling
You can cancel at any time in the app or by emailing [email protected]. Your subscription then runs to the end of the period you have paid for and does not renew; after that your account becomes read-only. We do not refund part of a month or year already paid for.
8. Closing your account
You can ask us to close your company’s account. Our privacy notice says what we delete and what we keep, and for how long. Download any documents you need before you ask.
9. Your account and your team
Give us accurate details, keep your sign-in secure, and tell us straight away if you think someone else has used your account. You are responsible for what happens under your account. A company admin who invites people is responsible for who they invite and what those people can see.
10. Reviewers
If you open a document through a review link, you do so to review it and, where appropriate, sign it off using your own professional judgement. The name and role you give are recorded as the sign-off. Keep the link to yourself.
11. Using Complly Risk fairly
- Use it lawfully and only for its intended purpose.
- Do not try to disrupt it, copy it, take it apart, or get into parts you are not allowed to.
- Do not upload anything unlawful, or anything you have no right to use.
If someone breaks these rules we may suspend or close their account. Unless the problem is serious, we will warn you first.
12. Who owns what
We own Complly Risk, its software and our content. You own what you put in and the documents you make. You give us the permission we need to store and process them so we can provide the service, and for the optional uses described in our privacy notice if they are switched on.
13. Looking after your company’s data
When your company puts details about other people into Complly Risk — for example the people on a briefing register, or the client named on a RAMS — your company decides how those details are used, and we handle them on its behalf. For those details we will:
- use them only to provide Complly Risk, and as your company instructs us;
- make sure everyone on our team who can see them is bound to keep them confidential, and keep them secure;
- use only the service providers named in our privacy notice, under contract, and tell you before we add a new one;
- help your company answer requests from the people the details are about;
- tell your company without undue delay if those details are lost or seen by someone who should not see them;
- delete them when your account is closed, as our privacy notice describes, unless the law requires us to keep them; and
- give your company the information it reasonably needs to show these promises are kept.
14. Our responsibility to you
We provide Complly Risk with reasonable care and skill. Beyond that, and as far as the law allows:
- we are not responsible for any loss caused by relying on a document that a competent person has not checked and signed off;
- we are not responsible for loss of profit, business, contracts or data, or for any indirect loss;
- our total responsibility to you is limited to £100 or the amount you paid us in the 12 months before the claim, whichever is higher.
Nothing in these terms limits our responsibility for death or personal injury caused by our negligence, for fraud, or for anything else the law does not allow us to limit.
15. Changes to these terms
We may update these terms. If a change matters, we will tell you in Complly Risk or by email at least 30 days before it applies. If you do not agree, you can cancel before then.
16. The law that applies
These terms are governed by the law of England and Wales, and the courts of England and Wales deal with any dispute.
